Petition to Amend Montana Rules of Evidence filed

On January 16, 2007, the Supreme Court’s Commission on Rules of Evidence filed a Petition to Amend Montana Rules of Evidence.  The Commission requests the following rule changes:

1.  Substituting and Adopting Amended Federal Rule 407

2.  Amending Rule 803( 8) to delete the last sentence

3.  Amending Rule 804(b) to add Federal Rule Subsection (6)

4.  Amending the first sentence of Rule 806 to delete a misplaced comma in the first sentence between (2) and (C)

AG documents filed in Montana v. Wyoming

Montana’s Attorney General filed a lawsuit in the United States Supreme Court against the state of Wyoming today.  The case involves Wyoming’s withholding of water from the Tongue and Powder Rivers.  The documents filed by the AG’s office in this original proceeding earlier today are available online here.
