NINTH CIRCUIT OPINION: Aageson Grain & Cattle v. USDA

The United States Court of Appeals for the Ninth Circuit has issued an Opinion affirming United States District Judge Sam E. Haddon’s decision in Aageson Grain & Cattle v. USDA, No. 05-36172, in which Judge Haddon held that the Equal Access to Justice Act applies to adversarial proceedings before the National Appeals Division of the United States Department of Agriculture.
